RECENT CHANGES IN PATENTABLE SUBJECT MATTER

Synopsis:  This presentation will provide a brief overview of intellectual property law and review the unique roles that patent, trademark and copyright law play in the US intellectual property system.  The majority of the presentation will focus on patent law and specifically patentable subject matter.  In the past few years, the Supreme Court in cases such as Alice Corp. v. CLS Bank Int'l has sought to clarify, or redefine, what is patentable and what is not.  The history of patentable subject matter will be discussed along with recent Supreme Court decisions concerning the patentability of business methods, human genes and software.

Presented by: William J. Kolegraff, Esq. and Robert D. Ward, Esq.  Bill Kolegraff is a patent litigator at the Irvine law firm Thomas Whitelaw & Kolegraff.  He is also a registered patent attorney with the U.S. Patent and Trademark Office and a former business executive who managed a sizable intellectual property portfolio for many years.  He has successfully litigated complex patent cases in several District Court venues, as well as at the ITC. Prior to joining Thomas Whitelaw, Mr. Kolegraff was Chief IP Counsel for Kyocera Wireless, a $1.4B wireless handset company.  In that capacity, he directed all of Kyocera’s patent litigation, which included litigation against Fortune 100 companies, non-practicing “trolls,” and individual inventors.  As a member of Kyocera’s executive committee, Mr. Kolegraff advised senior executives on all aspects of intellectual property matters.

Robert Ward, an associate at Thomas Whitelaw & Kolegraff, focuses his practice on intellectual property matters, specializing in patent law. He has experience in all phases of patent litigation including discovery, analysis of infringement risk and invalidity, motion drafting and trial preparation and support. His practice covers a broad range of technology within the mechanical, medical, electrical and software fields.  Mr. Ward received his J.D. from Notre Dame Law School. While at Notre Dame, he appeared on the Dean’s List and was acknowledged by the ABA for excellence in the study of intellectual property law. Mr. Ward also received a B.S. in Mechanical Engineering from the University of Southern California and holds a master’s degree in Mechanical Engineering from Loyola Marymount University.

OCPA is a State Bar of California Approved MCLE provider and certifies that this seminar qualifies for MCLE CREDIT 1.0.

Event Fee: $10.00 for OCPA members, $20.00 for non-members and $20.00 for all walk-ins who have not pre-registered online (both members and non-members).   

Parking:  There is a fee to park in the structure located behind the building.
